GENERAL TERMS AND CONDITIONS OF USE

MSH International, a simplified joint-stock company (Société par Actions Simplifiée) with a capital of €2,500,000 whose registered office is located at 39 rue Mstislav Rostropovitch – 75017 Paris, France, registered with the Paris Trade and Companies Register under no. 352 807 549, registered with ORIAS under no. 07 002 751 – https://www.orias.fr, subject to the French Prudential Supervision and Resolution Authority (ACPR) – https://acpr.banque-france.fr (hereinafter referred to as “MSH International” or “MSH”) provides the public (hereinafter referred to as the “User”) with the website: https://www.msh-intl.com/ (hereinafter referred to as the “Website”).Accessing and using the Website is subject to acceptance of these General Terms and Conditions of Use (hereinafter referred to as the “GTCU”).

ARTICLE 2 – PURPOSE

The purpose of these GTCU is to define the terms and conditions under which the User uses the Website.

 

ARTICLE 3 – ACCESSING THE WEBSITE

The Website is accessible free of charge (other than the cost of the connection) to any User with Internet access. All costs relating to access to the Website, whether in respect of hardware, software or Internet access, are payable exclusively by the User who is solely responsible for the proper functioning of their IT equipment and Internet access.

 

MSH International reserves the right to deny access to all or part of the Website, unilaterally and without prior notice, to any User who fails to comply with these GTCU.

When asked to provide information, the User agrees that this information will be accurate and up-to-date.

 

The User agrees not to copy, corrupt or attempt to copy, amend or corrupt in any way whatsoever, the content or computer programming of the Website pages.

 

The User agrees to comply with all applicable regulations of the country in which they are using the Website and, in particular, not to submit any documents, data or information of a defamatory, insulting, infringing, illegal, incorrect or falsified nature or which constitute a breach of the peace or an affront to public decency or which damage the technical functioning of the Website.

MSH International reserves the right to remove any requests for access to the Website which would be manifestly contrary to public order or decency or to prosecute any User who has committed an act which violates these provisions or the laws and regulations in force.

ARTICLE 4 – INFORMATION ON THE SERVICES PROVIDED4-a / Description

The Website enables the User to:

  • View the international health insurance products and service offerings.
  • Obtain an indicative estimate of the international health insurance product(s) matching their situation.
  • View partnerships intended for insurers, brokers or healthcare providers.
  • Get in touch with MSH.

 

4-b / Information on the Services

The information on the Website is provided for general information purposes and should not be treated as advice. In spite of content updates to the Website, MSH International shall not be held liable for any changes to administrative and legal provisions arising following publication. The User, regardless of their place of residence, is considered to have visited the Website on their own initiative for information on the services and products provided. The simulations presented on the Website are designed to provide the User with information by way of reference only. MSH International reserves the right, at any time and without notice, to amend and update this information as well as the content of the commercial offerings. The User shall be informed by any means whatsoever.

ARTICLE 5 – ACCESSIBILITY

The Website is available 24 hours a day and 7 days a week. However, MSH International may close down or make inaccessible all or part of the Website, in particular to carry out maintenance or at the request of any judicial authority and in cases of force majeure. Under no circumstances shall MSH International be liable for the non-availability of the Website and any total or partial interruption of the consultation of their pages. The User must check they have the electronic tools and means of communication, the access rights granted by MSH International and the skills to access the Website.

ARTICLE 6 – INTELLECTUAL PROPERTY

6-a / Copyright

All components of any kind (static images, animated images, databases, trademarks, illustrations, logos, designs, templates, layouts and downloadable documents) on the Website are protected as a creative work under the French and international legislation on copyright and intellectual property. These components remain the exclusive property of the DIOT-SIACI group, unless otherwise specified. As such, unless prior written permission is given, any partial or total reproduction, representation, adaptation, or modification of any component of the Website, by any means whatsoever, is prohibited under penalty of prosecution.

 

The trademarks and logos displayed on the Website are registered. Any reproduction, republication or redistribution of all or part of the trademarks or logos, by any means whatsoever, without prior written permission is prohibited.

 

6-b / Using the Website

The User agrees not to adapt or change all or part of the Website, or to use it for any purpose other than that permitted by MSH.

ARTICLE 7 – LIABILITY

The information contained on this Website is not legally binding and may be amended at any time by MSH International. MSH International does not guarantee the accuracy of the information contained on this Website; under no circumstances shall the company MSH International be held liable as a result of the use of the information provided on this Website or the absence of specific information.

Article 8 – CHANGES TO THE GTCU

MSH International reserves the right to make changes to these GTCU, which will be subject to acceptance by the User.

 

ARTICLE 9 – FORCE MAJEURE

MSH International shall not be held liable for any harm, loss or damage resulting from a case of force majeure as defined under French law and jurisprudence.

 

ARTICLE 10 – COMPLAINTS

When a User is dissatisfied with the processing of their request, they must first inform their usual point of contact so that the nature of the dissatisfaction is understood and solutions are sought.

Ultimately, the User may take any legal actions.

 

 

ARTICLE 11 – GOVERNING LAW – COMPETENT JURISDICTION

These GTCU are governed by French law.

Any dispute arising from the GTCU shall be under the jurisdiction of the French courts.

 

ARTICLE 12 – SUPERVISORY AUTHORITY

The supervisory authority of MSH International is the French Prudential Supervision and Resolution Authority located at 4, place de Budapest, CS 92459, 75436 Paris Cedex 09, France – www.acpr.banque-france.fr
